Legal definition of "suspension"

Post by SarahND » Wed Aug 16, 2006 5:19 pm

Hello all,
Could someone please tell me what this is likely to be all about? (found in the NAS catalogue). The two involved were father and son-- what does suspension mean in this case?

Thanks,
Sarah

Hi Sarah

I've looked this up and there are 2 possible definitions for a bill of suspension and interdict. The first is a procedure in the Court of Session to stay/stop temporarily the carrying out of a procedure to enforce a debt or judgement e.g. the enforced sale of the goods of a debtor or someone who has a court judgement against them

Secondly a procedure in the Court of Session to prevent the infringement of a right by a deliberate act which is threatened or being performed.

I would guess that the second of these is more likely in your context but what exactly happened who can tell without seeing the whole court papers. Might just be interesting.

Thank you Anne! It does, indeed, sound interesting. Hmmm :-k I wonder what was going on?! I will definitely look this one up when I go to Edinburgh in November. It's beginning to look like I will need at least a week at NAS... (and another week at the Mitchell, and one in Aberdeen as well!)
Thanks again,
Sarah
