If a woman was widowed and then later remarried would she be found under her maiden surname or her first married surname?

The simple answer is YES
In other words she may choose to go back to her maiden name or may retain her first husband's name as she chooses.
We downloaded one last night where she retained her first husband's name on her second marriage yet appears in census returns when widowed for the third time, under her maiden name.
At least her son by her third husband got things right when he registered her death. He included all three previous names.
Under Scots law a woman can retain her own name.

My three greats grandmother was listed at death as Joan FENWICK, previously PATON, formerly THOMSON, maiden surname WOODROFFE, and I have often seen that pattern in other records with other remarried individuals as well. She was married to 3 individuals, having been widowed twice, though I have never found her marriage to mystery man THOMSON.

If the person registering the death knew of her previous marriages the all names will be listed at SP.
Careful searching will keep costs at a minimum.
Do you want to give us the names or do you prefer to hunt yourself?

Hi Steve,
If all of the names were given at the time of registration, then she should be indexed by all names used up to that point. On a census, she is most likely to be found by her most recent name, or very occasionally you will find a married or widowed woman listed under her maiden name.

Just a thought
If a marriage survived through a census especially the later one(s) sometimes you can find her by looking for the children of the previous marriage. If they were old enough to choose they often retained the name of their father. We have sometimes found three different surnames all living at the same address.

This was a follow up to a question i asked on Statutory Records about finding the death of Margaret Mitchell m.s Gourlay.Since i could not find her death i thought she may have remarried so would be recorded under another surname.Although the chances of this is remote as she was already 65 on the 1891 census, you never know till you look.
