George McKemmie.....

George McKemmie was the executor of wife's will and she is referred to in her will as "Hellen Borland or McKemmie sometime wife of George McKemmie miller Camlachie Mills Glasgow who died at Glasgow upon the 21 day of November 1848 years". If she is his "sometime wife" does that mean they they were separated or divorced?

I can't find George in the 1851 census or a death after 1855. Does anyone know what sort of record the above may be and whether it might be an indication of his death?

I'm not at all sure about the "sometime wife" - it does seem to suggest on the surface that they may not have stayed together - however, I'll leave that one to someone who knows about these things, rather than making guesses! Could it maybe mean that George had predeceased her?

The CS part of CS313 stands for Court of Session - which covers things like Register of Deeds, processes & court cases. So it could contain a deed and perhaps some indication of his year of death. I'm not sure that I'd worry too much about the date being after you think he may have died - I certainly have many cases where the date of a legal document is after a known date of death. I wonder if it is perhaps to do with either the distribution of his estate or it may be that John McKemmie had been appointed as a guardian or trustee for the children in the event of George's death or somesuch. But this is just pure speculation - whenever I try to second-guess what is in documents from NAS they always turn out to have a few surprises in them!! I'd be tempted to contact NAS, get an idea how many pages the document runs to, and thus an idea of photocopying costs and maybe have it sent to you.

I hope someone else may be able to help you out more with the legal stuff!

Thanks for replying. George McKemmie was alive in 1849 when the will was executed. He was in the 1841 census in Ayrshire born out of county.
My impression from the NAS site was that they were encouraging you to contact professional researchers to get the information

Usually there is no problem with requesting a particular document - you have a ref. for it, - CS313/228 so it should be pretty straight forward.
I think what they try to discourage is the sort of "Can you check the Kirk Session records of X parish for any mention of John McDonald" type of vague request!

The births of George and his 10 siblings born in Kilbarchan are not on LDS or the Scottish OPRs on SP, which was why I hoping to find a bit more on him.

Have you tried the British Vital Records Index? You may be able to find it in a library perhaps or some kind person here may have access to it & be able to check for you - it contains 147,879 births & christenings for Renfrewshire but as with everything else, does not claim to be a complete record. Worth checking, but, of course, they may not be there either. ( I have some vague memory of BVRI not being availble in Australia for some reason - 'though I may be wrong & have maybe got it mixed up with something else )

there are at least three different McKimmie families in Kilbarchan on the 1841. I picked them up on freeCen but don't have the copy to hand.
One in Ewing street and one in New Street that I remember. Remember the latter one because there is a McKinnie staying near there today.

Forgot to mention, I have about 18 Borlands in my tree - they are Ayrshire families, so there may be some connection. They are fairly peripheral in my tree - they married into my Parker & Lyon 1st cousins several times removed & so some of them are distantly related. Too late to type them up just now, but if you are interested in them, let me know & I'll send you what I have. I don't have a Helen, but she may be the sister of one I do have, as I don't know a lot about them.

Isabella's parents were James Borland and Isabel Morton, her siblings were Janet & Helen. In 1851 they were at Carsland, Galston, Ayrshire. James was a landed proprietor farming 300 acres.
