You pose an interesting question and one that I'm not sure can be proved one way or the other...were they indeed married? Not only does William state his mother's name as SMITH and widow of only William SMITH....in 1871 census you'll find Elizabeth using the surname of SMITH (Just one year after the death of William LAURIE!!) She's also is still on the same property as farmer of 44 acres. And in 1881 here is William and family probably farming the very same property....

thank you for taking the trouble to help solve this mystery.
i'm thinking now that the information given on william lauries death cert. was wrong and that he and elizabeth were never married
the 1841 census is williams parents - robert laurie and jean (nee scott )
on it it gives william aged 25 but no sign of AGNES
i have a copy of a marraige between william & agnes smith on 22.5.1840.
also on their son roberts marraige certificate it names them as his parents. so agnes definately existed.
will try to find a death certificate for her. have had the thought she may have died between 1840/1841 or failing that left her husband and child.

Do you happen to have a copy of the OPR 1840 marriage record or just what the IGI gives? I'm wondering if it might state any more info on Agnes....as in age....or father's name?? It might be worth the gamble to get a transcript of this if you don't have it already. Because Robert Laurie's age is given as 10 on the 1851 census it surely narrows up a small time window. You don't happen to know his exact date of birth? or even place of birth? I noticed the 1851 census seemed to omit this. Maybe Agnes and baby were out of Carluke when the 1841 census was taken....or maybe Robert had not been born yet and Agnes was still out of town. The complete 1841 census indexing soon to be released on SP may help.

William Laurie in this parish & Agnes Smith in the parish of West Calder. no objections were offered - names given in by Robert Laurie.
William Laurie & Agnes Smith were married on 22nd May 1840.
i have searched for their son Roberts birth certificate but have never found one. i do have his marraige certificate.
16th October 1863 at New Lanark
Robert Lawrie ,Tailor, bachelor, age 23 usual residence Whitburn. Father William Lawrie. Mother Agnes Lawrie ms Smith.(does not say deceased )
having studied the census records i agree with you that William Laurie moved into Blythbank and Eliz. Smith was the true owner.

I have one like this on the 1841 Census too my ancestors married in Eddlestone 1841 just before the Census.By the Census they are residing in Glencorse with her Father/StepMother & she is enumerated using her maiden name.If Husband hadn't been with her would have thought she had disappeared but no they had gone to visit?live with Dad.

The West Calder hint from the OPR was the clue you needed!!! You've found your Agnes and baby!!!
The fact that Agnes is not listed as deceased on Robert's MC does leave open to speculation she may have left the family. It might be worthwhile to attempt to track her parents deaths or her siblings. Sometimes you get lucky and find someone as an informant.
As always....one mystery solved and another takes it's place!

thanks to you i have tracked down William living with Elizabeth Smith at Blythbank West Calder but now i'd like to know what happened to his ABANDONED wife Agnes Smith.
i have records of their marraige and she appears on the 1841 & 1851 census at Glenhutch West Calder but has dissapeared with all her family on the 1861 census.
