Hi Sarah,
I am not an expert, and I'll be interested to hear what the experts think. That being said, my gut says taht unless your index uses copyrighted material, I'm not sure how it is any different than someone writing any other sort of thing about an existing book, such as a book review or literary criticism or whatever.

A terrible thing happened
I'm sure I had my well-thumbed copy of Alienated Affections when I was sitting in the airport in Paris waiting for the plane. By the time I got off the plane in Detroit, however, it had vanished.
This was the copy where I had pencilled in hundreds of names and page numbers to add to the index... and I had only managed to type surnames A-B into my computer
I hadn't indexed the whole book, but had done the large part of it. So... I just found a used copy on Amazon for $5.20 and will get back to work when that arrives.
Wonder who will find the copy in Paris?!
