Leckie vs Leckie 1776

Post by Lorna B. » Mon Oct 27, 2008 2:22 pm

With the help of Talking Scot I have reached further back into my family history than I had anticipated.
While researching my grandmother x7, Elizabeth Leckie, I have come across a reference on the internet to her suing her sisters for part of her father's estate, or that is as much as I can understand of it! I have confirmed that the records are held at the National Archives of Scotland.
I am quite surprised that in 1776 a woman would have been in a position to sue her sisters in court. I am wondering what it tells me about both her, and her circumstances. Was this unusual? I believe that her husband, George Stanners, was a shoemaker in Linlithgow.
Can anyone tell me how common this was at that time.

This might be one of those areas where there is a difference between Scots and English Law.

You may notice I'm keeping very quiet about this so far the reason being that I'm sure I should know the answer but am not altogether sure what the rules for women litigating were, especially married women. I'll try and check up.

It probably needs a visit to the Scottish Archives to read the case. Whether I would be able to understand it remains to be seen. Have a good Halloween.
