I know it's not what you are looking for but just in case you don't have it- this looks like James's mum living a few doors away in 1841.

Perhaps the marriage was irregular and that's why it doesn't appear in the OPR's. I found one of mine that isn't indexed on the IGI or SP while browsing the film.

Sorry for the mix up in JOHN & JAMES.

Annette -Thanks for you help, this is the family.

Sarah- Thanks for the marriage, not sure of the McAmond, and yes anything is a possiblity, and finding the ? Mother.?

Andrew- for the list on IGI minus James born 8 Nov 1846. + the 1851/1861/1871/ census.

Not sure of the year they left for America but Jane Ferguson died ther 1881 Holt, Nebraska.

Would someone please remind me again what an "irregular marriage" means. :roll:

Bear in mind that 'irregular' marriages, by exchange of promises before witnesses, by betrothal and consummation, or by cohabitation and repute, were forms of marriage recognised by Scots Law, yet may have taken place without any official record of the event.

Any marriage that did not include a proclamation was considered an irregular marriage and was dealt with by the Kirk Session elders of the local parish. That could include eloping to a Justice of the Peace, or common law marriage. Elopement was a concern because of the not infrequent kidnapping of young heiresses.

Hello Trish,

Chances are you’ve seen this already but Ancestry has a book on the McMath Family including reference to a “James Kennedy McMath, of Ayr, Scotland”. I haven’t seen the content.

Good morning!

I found out recently that my 2x great grandparents were married after being declared in "ante-nuptial fornication". Guess it's a good thing they didn't have red ink back then! :o They had their first child a few months after being married and went on to have four more and were married for twenty plus years until my 2x great grandfather died.

I've wondered many times if these various types of "irregular" marriages aren't where so many of our relatives are hiding when they seem to disappear from earth! :?:

Hmmm. That book seems to tell a slightly different tale-- I wish they had cited references! But the May 15, 1816 birth for Jane is close enough to the May 17, 1814 christening I found to make me feel it is the same person. The year could easily have been off.

Looks like you'll have an interesting time trying to check all that out, Trish! :D
